Abstract
This thesis is titled "Provision of Remission for Narcotics Abuse Prisoners in Class I State Detention Centers in Palembang City". The writing of this thesis is motivated by the conviction in the misuse of narcotics abuse who undergo imprisonment has rights protected by human rights and the law, one of which is by granting remission. The Existence of Government Regulation Number 99 Year 2012 concerning (Second Amendment to the Regulation Government Number 32 of 1999 Concerning the Requirements and Procedure for the Implementation of the Rights of Prisoners Convicted People (Equality Before the Law) which distinguishes the granting of remissions for ordinary criminal convicts and convicted perpetrators of extraordinary crimes. That the tightening of remissions for extraordinary crimes, especially for convicted narcotics cases in Indonesia, is contrary to the basic ideology of the Indonesian state, Pancasila. The problems discussed in this thesis are about the mechanism of remission for prisoners of narcotics abuse in the Palembang First Class State Detention House. and constraints in granting remissions for prisoners of narcotics misuse in the Palembang First Class State Detention Center. The type of research used is empirical legal research. The research approach used is the sociological research approach. The writing of this thesis is based on primary data sources obtained through the words and actions of people observed or interviewed as well as secondary data sourced from the literature namely legislation, official documents relating to the problem. The data sources are analyzed by qualitative data analysis methods and drawing conclusions using deductive logic. The results showed that the mechanism for granting remission technically conducted by Palembang Class I Detention Center was to examine the status of Penitentiary Guidance Citizens, then propose to the regional office, after receiving a decree from the regional office, detainees were determined whether to get remission. In granting remissions to prisoners of narcotics misuse in the Palembang City Class I Detention Center, there are obstacles to the coaching programs of the Palembang Class I Detention Officers that have not been fully accepted and can be fully carried out by the inmates.
