Abstract

ASEAN is a regional organization in Southeast Asia. Formed in 1967 with an initial membership of five countries, in ASEAN there is a principle that is upheld, namely the Principle of Non-Intervention. This principle is contained in Article 2 point (e) of the ASEAN Charter. Non-Intervention in ASEAN is an agreement from member countries as a form of respect for the sovereignty of each member country and does not interfere in the domestic affairs of member countries. Given the interests of each member in developing their country, it is not uncommon for political tensions to occur both inside and outside, one of which is Myanmar. As is currently happening from 2021 to 2023, namely a military coup in which Myanmar's military forces (Tatmadaw) control the government. So that it raises the question of whether the principle of Non-Intervention in the ASEAN CHARTER is still relevant to the current situation. This research uses normative legal research methods that focus on library research by examining primary, secondary and tertiary materials. And the results of this study are the Non-Intervention Principle can be said to have strengthened ASEAN as a regional organization in a region that has cultural and cultural differences, but over time this principle has made ASEAN get a lot of criticism from the international community, so ASEAN is pressured to be able to review such as Constructive Engagement, Constructive Intervention, Flexible Engagement, and Enhanced Interaction. The application of the Non-Intervention principle in ASEAN must be flexible and not static as it is today and refer to the Non-Intervention principle in the UN charter, so that ASEAN can further realize peace and security in the region. In addition, ASEAN must actively and effectively solve existing problems in the future.
