Abstract
ABSTRACT Legal Policy on Termination of Employment Prior to the Formation of Law Number 11 of 2020 Concerning Job Creation: This legal research delves into the legal aspects of employment termination before the enactment of Law Number 11 of 2020 Concerning Job Creation, which was formulated through the omnibus law method. The study focuses on the regulations regarding employment ternination outlined in the Job Creation Law. The research employs a normative legal research method with a legislative and case law approach. Legal materials are analyzed using a descriptive qualitative analysis technique. The thesis discusses various aspects, including: (a) unilateral termination of employment; (b) legal protection for workers based on the 2023 Job Creation Law; (c) legal protection for workers affected by future employment termination. Legal protection concerning unilateral employment termination is stipulated in Article 153 of the Job Creation Law, where mployers are prohibited from unilateraly terminating employment. The rogulations related employment termination are governed by Aricle 15l of Law Number 6 of 2023 Cancerning Job Creation. In the concept of preventive legal protection, the state must draft legislation that includes provisions warming employes against unilateral employment Sermination in the future. This legislation should involve a reevaluation of terminated workers, If the evaluation reveals no wrong doing or harm caused by the workers, their semination is deemed invalid. In the concept of repressive legal protection, workers who are eminated must receive full protection from the state, Including free legal assistance.
