Abstract

The Regional Notary Supervisory Council as a body formed by the Minister of Law and Human Rights, not only has the authority to supervise and examine Notaries, but also has the authority to impose certain sanctions on Notaries who have been proven to have violated the law against the Notary's position regulations as regulated in Law Number 2 2014 concerning Notary Positions. This research examines the actions of the Regional Notary Supervisory Council towards Notaries who commit violations of holding multiple positions as advocates. This research method uses normative research based on legal facts sourced from the substance of statutory regulations and literature related to the problems the author discusses. The results of the discussion explained that as a result of the law of a Notary who holds the same position as an advocate, the Notary profession does not solely apply according to statutory provisions and the professional code of ethics. The Notary Supervisory Board's role is to prevent or correct errors, deviations and other things that are not in accordance with the specified duties and authority. Supervision is not to find fault with the person, but to find fault with the results of the implementation of the work. The conclusion produced in this research is that regarding the decision of the Notary Supervisory Council at the level of examination there are differences in decisions between MPD, MPW, and MPP due to the considerations held by each panel. . However, the results of the decision still agreed to provide sanctions for violations committed by Notaries related to holding multiple positions.
