Abstract

The purpose of this research is to analyze the role of notaries in resolving notarial deed disputes through Alternative Dispute Resolution, analyzing notaries as legal consultants for parties and implementing the notary's code of ethics in about their position. This research was conducted using the Normative Legal Research method which will attempt to answer several problems. In carrying out his duties and authority, the notary is involved in resolving the parties' disputes through mediation as a mediator who facilitates the mediation process. By paying attention to the rules regarding prohibitions on notaries as regulated in Article 17 of the Law on the Position of Notaries stated in various nomenclatures and interpretations, there is no prohibition on notaries becoming mediators because mediators are not state officials. In the Notary Law and the Notary's code of ethics there is no prohibition on notaries becoming mediators. Mediators are not classified as civil servants, state officials, advocates, leaders or employees of State-Owned Enterprises, Regional-Owned Enterprises or private entities.
