Abstract

This thesis is entitled "Criminal Sentencing of Online Gambling Users Committed by Civil Servants in Decision Number 1024/Pid.Sus/2022/PN Tjk." The crime of online gambling is regulated in article 27 paragraph 2 of Law no. 19 of 2016 concerning amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions. Perpetrators of online gambling crimes do not only occur in ordinary society but also occur among civil servants. Civil Servants who are part of the State Civil Apparatus are obliged to comply with their obligations and avoid the prohibitions stipulated in Government Regulation no. 94 of 2021 concerning Civil Servant Discipline. The problem in this thesis is how to impose criminal penalties and criminal liability for online gambling perpetrators carried out by Civil Servants in Decision Number 1024/Pid.Sus/PN Tjk. This research uses normative legal methods, namely research carried out using the study of library materials or secondary data which results in deductive conclusions. The results of this research show that the judge does not view the Civil Servant profession as a reason to aggravate the punishment of perpetrators who use online gambling so that there is no deterrent effect on the perpetrators. As a result, government employees, including civil servants, will continue to commit criminal acts of online gambling.
