Abstract

Skripsi ini berjudul “Pertimbangan Hukum Hakim Mengenai Penghitungan Kerugian Keuangan Negara Dalam Tindak Pidana Korupsi (Putusan Nomor 37/Pid.Sus-TPK/2021/Pn.Plg).” Adapun rumusan masalah dalam penulisan skripsi ini; bagaimana pertimbangan hukum hakim dalam Putusan Nomor 37/Pid.Sus-TPK/2021/Pn.Plg, dan bagaimana kewenangan Hakim dan Badan Pemeriksa Keuangan dalam menghitung kerugian keuangan negara. Hasil penelitian ini menunjukkan bahwa majelis hakim pada Pengadilan Negeri Palembang memiliki prinsip kehati-hatian dan melakukan analisis terhadap bukti persidangan, hakim dalam mempertimbangkan unsur kerugian tidak hanya berdasarkan hasil audit dari BPK dan dari ahli lainnya yang telah dihadirkan oleh Jaksa Penuntut Umum, melainkan juga bukti yang diberikan oleh terdakwa. Putusan ini menunjukkan independensi hakim dalam menilai bukti, namun dalam peraturan perundang-undangan yang berlaku tidak ditemukan kewenangan hakim untuk menghitung sendiri kerugian negara, hasil audit dari instansi yang berwenang yaitu BPK yang harus menjadi dasar hakim menilai kerugian keuangan negara.
