Abstract

Developments in the technology sector continue to progress which has implications for the level of crime, one of which is cyberporn. In the legislation, the cyberporn is not stated clearly, but only regulates about crimes against morality. While the Pornography Law only regulates pornography. So if a cyberporn crime occurs, the settlement process is the same as a conventional crime. Based on the explanation above, the legal problems that will be analyzed in writing this thesis are: 1). How is the determination of tempus and locus delicti in the process of investigating cyberporn crimes?, 2). How is the determination of tempus and locus delicti in the process of investigating cyberporn crimes in the future?. Normative research method used empirical data. The results of the research that has been conducted by the author can be concluded that: regulations regarding cyberporn crimes were not regulated specifically in the legislation, including in determining tempus and locus which causes differences in the use of determination methods. If Based on the author's research at the South Sumatra Regional Police, so the determination of tempus uses the method of the time the victim received treatment and locus based on the IP address used by the perpetrator. 2). Determination of tempus and locus in the process of investigating cyberporn crimes has lack related to regulations, overlapping authorities, differences in jurisdiction, lack of technological infrastructure and limited costs for cyberporn crimes. So, therefore, it is necessary to reform the law by ratifying the RUU PTI Bill and renewing the Criminal Procedure Code (KUHAP) and updating non-penal facilities.
