Abstract

Penulisan skripsi ini bertujuan untuk mengetahui dan menganalisis pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku tindak pidana yang tidak memelihara kapalnya sehingga tidak memenuhi persyaratan keselamatan kapal pada Putusan Nomor: 122/Pid.B/2019/PN/Btm serta untuk mengetahui dan menganalisis penerapan sanksi pidana terhadap pelaku tindak pidana dalam putusan 122/Pid.B/2019/PN/Btm. Raja Fadillah merupakan seorang terdakwa dalam putusan 122/Pid.B/2019/PN/Btm, dia didakwa oleh Jaksa Penuntut Umum dengan dua dakwaan yaitu dengan Pasal 302 ayat (1) dan Pasal 305 Undang-Undang Nomor 17 Tahun 2008 Tentang Pelayaran. Dengan pertimbangan dari sisi yuridis dan sisi non yuridis maka hakim menyatakan terdakwa Raja Fadillah terbukti secara sah dan menyakinkan bersalah melakukan tindak pidana “TIDAK MEMELIHARA KAPALNYA SEHIGGA TIDAK MEMENUHI SESUAI PERSYARATAN KESELAMATAN KAPAL SEBAGAIMANA DIMAKSUD DALAM PASAL 130 AYAT 1”
