Abstract

Penelitian ini berjudul Penjatuhan Sanksi Terhadap Pelaku Tindak Pidana Korupsi Secara In Absentia. Permasalahan yang diangkat dalam penelitian ini adalah bagaimana pengadilan menerapkan proses hukum terhadap terdakwa tindak pidana korupsi yang tidak hadir dalam persidangan (in absentia), serta apa saja dasar pertimbangan hakim dalam menjatuhkan putusan dalam perkara korupsi yang diadili tanpa kehadiran terdakwa. Penelitian ini bertujuan untuk menganalisis penerapan penjatuhan sanksi terhadap pelaku tindak pidana korupsi secara in absentia di Indonesia, serta mengidentifikasi pertimbangan hakim dalam memutuskan perkara tersebut. Penelitian ini menggunakan pendekatan yuridis normatif dengan menganalisis tiga putusan pengadilan, yaitu Putusan Nomor 73/Pid.Sus-TPK/2023/PN Plg, Putusan Nomor 71/Pid.Sus-TPK/2022/PN Mdn, dan Putusan Nomor 127/Pid.Sus-TPK/2022/PN Smg. Hasil penelitian menunjukkan bahwa pengadilan tetap dapat menjatuhkan putusan meskipun terdakwa tidak hadir, selama pemanggilan telah dilakukan secara sah sesuai dengan ketentuan Pasal 38 Ayat (1) Undang-Undang No. 31 Tahun 1999. Penjatuhan sanksi secara in absentia merupakan bentuk penegakan hukum yang menjamin kepastian hukum dan mencegah kebuntuan proses peradilan. Pertimbangan hakim dalam menjatuhkan putusan didasarkan pada alat bukti yang sah, prinsip keadilan, kepentingan publik, serta dampak perbuatan terdakwa terhadap negara dan masyarakat.
