Abstract

Penelitian ini bertujuan untuk menganalisis pertimbangan hakim dalam memutus perkara kepailitan terhadap ahli waris yang memiliki kewajiban atas utang pewaris sebagaimana termuat dalam putusan Pengadilan Niaga Makassar Nomor 1/Pdt.Sus-Pailit/2021/PN Niaga Mks. Perkara ini bermula dari pengajuan permohonan pailit oleh empat orang kreditur dengan total piutang sebesar Rp3.310.239.000 terhadap ahli waris yang belum melunasi utang pewaris (suaminya yang telah meninggal dunia). Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual, dan pendekatan kasus (case approach), serta analisis data dilakukan secara deduktif. Hasil penelitian menunjukkan bahwa tanggung jawab hukum ahli waris dalam pelunasan utang pewaris diatur dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang (PKPU). Dalam pertimbangannya, hakim mengabulkan permohonan pailit karena seluruh syarat kepailitan telah terpenuhi, serta berdasarkan fakta persidangan yang menunjukkan adanya surat utang dan somasi dari para kreditur. Dengan demikian, permohonan pailit oleh para kreditur dinyatakan dikabulkan oleh majelis hakim.
