Abstract

Pada tahun 2021 dilakukan uji formil Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja di Mahkamah Konstitusi, kemudian diputuskan bahwa undang-undang tersebut inkonstitusional secara bersyarat. Mahkamah Konstitusi memerintahkan DPR dan Pemerintah untuk memperbaiki Undang-Undang tersebut dalam waktu 2 tahun. Selama masa perbaikan Undang-Undang Cipta Kerja pada tahun 2022 Presiden mengeluarkan Perppu No. 2 Tahun 2022 tentang pencabutan Undang-Undang Cipta kerja. Akibatnya objek putusan Mahkamah Konstitusi yaitu Undang-Undang Cipta Kerja menjadi hilang, dan putusan Mahkamah Konstitusi tidak ditindak lanjuti. Penelitian ini bertujuan untuk menganalisis Kewenangan Mahkamah Konstitusi dalam menguji Perppu dan implikasinya terhadap hubungan antar lembaga negara, dengan menggunakan metode yuridis normatif dan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan historis. UUD NRI 1945 tidak memberikan secara langsung Kewenangan Mahkamah Konstitusi untuk menguji Perppu begitu juga di dalam UU, sedangkan Mahkamah Konstitusi melakukan tafsir terhadap konstitusi sehingga Mahkamah Konstitusi dapat melakukan pengujian terhadap perppu, dan berimplikasi terhadap hubungan antar lembaga negara dengan Presiden dan DPR.
