Abstract

Capital markets have a strategic role in national development. In supporting the process of transactions carried out by the parties which are conducting activities in capital markets,, the Capital Market Supporting Professionals are formed. Notary as one of the professions Capital Market Support, in the Act of Notary Position, the authority as public officials to make authentic deeds. Notary who will carry out his activities on the Market Capital must be registered with Bapepam-LK which has changed to the Financial Services Authority. The Financial Services Authority is an independent institution that has authority to organize regulatory and supervisory functions in the financial services sector activities by leviing capital market supporting professionals, including notaries. This certainly matters to this profesionals. This thesis study discusses concerning legal protection for Notaries as a capital market supporting profession by concerning imposition of levies by the Financial Services Authority. This type of research is normative legal research using the statutory approach, conceptual approach, and case approach. The type and material of the study were obtained from secondary data consisting of materials primary law, secondary legal materials, and legal materials. Techniques of law material collectin through library research, analyzed qualitatively, with withdrawal techniques deductive conclusions. The results of this study are, first, the philosophical foundation of the Service Authority Finance carries out levies on Notaries as Capital Market Supporting Professionals a levy as a source of operational funds for the Financial Services Authority with all activities related to the regulation and supervision of the financial services sector that can be carried out more independently. Second, the role The Financial Services Authority in the preparation and supervision of affected Notaries legal issues are non-existent. Even Notaries who are exposed to internal legal problems activities in the capital market will be sanctioned in the form of administrative sanctions, civil sanctions, and criminal sanctions.
