Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui faktor-faktor penyebab ahli waris ninggal kedaton tetap memperoleh hak atas tanah waris. Dalam penelitian ini yang menjadi populasi adalah orang tua yang ahli warisnya ninggal kedaton tujuh orang dan seorang Ketua Adat (Kelian Adat) dengan itu keseluruhan berjumlah delapan informan. Penentuan sampel dalam penelitian ini menggunakan teknik purposive sampling, dimana pengambilan sampel ditentukan berdasarkan pertimbangan tertentu. Teknik pengumpulan data yang digunakan adalah dokumentasi, wawancara dan observasi. Teknik analisis data menggunakan reduksi data, penyajian data, dan penarikan kesimpulan. Berdasarkan hasil analisis data dan pembahasan dari ketiga teknik pengumpulan data, dapat disimpulkan bahwa terdapat tiga faktor penyebab ahli waris ninggal kedaton tetap memperoleh hak atas tanah waris yaitu faktor internal masyarakat, faktor sosial budaya, dan faktor pendidikan. Kata Kunci: Ahli Waris Ninggal Kedaton, Hak Atas Tanah Waris ABSTRACT This study aims to determine the factors that cause the inheritance of the survivors of Kedaton to still obtain rights to inheritance land. In this study, the population was parents whose heirs left the Kedaton seven people and a Chair of Adat (Kelian Adat) with a total of eight informants. Determination of samples in this study using purposive sampling technique, where sampling is determined based on certain considerations. Data collection techniques used are documentation, interviews and observation. The technique of analyzing data uses data reduction, data presentation, and conclusion drawing. Based on the results of data analysis and discussion of the three techniques of data collection, it can be concluded that there are three factors that cause kedaton's heirs to remain entitled to inheritance rights, namely internal community factors, socio-cultural factors and educational factors.
