Abstract

A Notary as general officer is a trusted position who is given atribution authority by the Law to deal with the issue of making proof tool in the form of an authentic act. Notary is submitted to the provisions of Law Number 2 Year 2014 regarding the Notary Position, which is the guideline and provision in the implementation of his position. A Notary is appointed by the minister and obliged to take Notary position oath, besides to become a Notary, notary candidate must pass the course of second strata of notoriety, 2 years internship and must collect points through seminars and training of Notary education. A notary in running his position must not leave his position post territory for 7 consecutive days, Notary as a public official has the right to leave and is obliged to appoint a Substitute Notary who is entrusted to continue the Notary when the Notary is unavailable. Substitute Notary is appointed by Notary and is appointed as Substitute Notary with a very simple requirement that is limited to Indonesian citizen who graduated from law and has worked as Notary office employee for at least 2 (two) consecutive years. The requirement above is to simplify the administrative process in submitting the Substitute Notary which is commonly the the Substitute Notary is appointed from the Notary employees himself in order that the Notary can still control his office even if the juridical right and the authority have switched to the the Substitute Notary who is believed to replace him in running the office administration and the Notary office protocol substitited for it keeps running as it should and continues to provide service to the needy community. Requirements to appoint a Substitute Notary This is considered as a form of problem because the Substitute Notary submitting mechanism is considered to be too easy, but given great authority and responsibility, as well as binding the Substitute Notary for his lifetime. This study is a normative law research that examines in depth and explicitly used as a reference to know concrete legal analysis of the problems studied.
