Abstract

Investigation and Prosecution of Forestry Crimes Based on Article 111 of Law No.18 of 2013 concerning the Prevention and Eradication of Forest Destruction by reviewing the application of the authority to investigate and prosecute forestry criminal acts based on Article 111 paragraph (2) of Law No.18 of 2013 in Indonesia , as well as offering alternative arrangements for the authority to investigate and prosecute forestry criminal acts in the future, carried out with a legislative approach, conceptual approach, case approach and analytical approach. The legal materials used in this study include primary and secondary legal materials that were explored through literature studies, as well as the use of information technology. After processing the research material and analysis using the method of legal interpretation, a deductive conclusion can be drawn that the authority to investigate and prosecute forestry criminal acts based on article 111 paragraph (2) of Law Number 18 Year 2013 has not been implemented, because "prevention and eradication of forest destruction "has not yet been established, therefore the authority to investigate and prosecute forestry criminal acts can still be carried out based on the previous provisions. In other words, the public prosecutor and judge can override article 111 of Law no. 18 of 2013. In the future the authority to investigate and prosecute forestry criminal acts must still refer to Law Number 18 of 2013 and the Criminal Procedure Code. This research recommends that the government should immediately issue government regulations that form the Institute for Prevention and Eradication of Forest Destruction so that legal certainty occurs. In addition, it is also recommended to immediately improve Article 111 of Law No. 18 of 2013, where the institution of Prevention and Eradication of Forest Destruction that will be formed consists of elements of the National Police investigator, PPNS Investigator, JAKSA, as well as other experts, who are domiciled and accountable to the president.
