Abstract

The Rantau Dadap – Lumut Balai 150 kV High Voltage Transmission Line construction project was targeted to operate on June 2020 and it required 115 (one hundred and fifteen) towers and 115 (one hundred and fifteen) right of way under the transmission lines. In order to provide the right of way for the transmission lines, PT PLN (Persero) has the obligation to provide compensation for the land, buildings and / or plants under the right of way of the high voltage transmission lines to the rightful parties in the form of money. This thesis aims to see the implementation of compensation for land, buildings and / or plants by PT PLN (Persero) in accordance with the procedures regulated by Minister of Energy and Mineral Resources Regulation Number 27 Year 2018 on Compensation for land, buildings and / or plants Under the Right Of Way of The High Voltage Transmission Lines. Based on the result of the study, it can be concluded that PT PLN (Persero) is still experiencing difficulties in providing compensation in accordance with the provisions and procedures which has been determined by constitutional laws and regulations, and the refusal from the land, building and / or plants owners on the compensation value which is determined by the appraisal institution at 15% (fifteen percent) from the land and building market values without any chance on negotiation between both parties, and it is only allowed once in providing the compensation. By considering to the local cultures and those constrains therefore PT PLN (Persero) has made a persuasive approach to the land, buildings and / or plants owners in order to receive the compensation by involving with the village elders, village and sub-district officials, and also Bintara from Indonesian Armed Forces (Babinsa), which effects on the declining of the project construction completion that has been planned. It is recommended that the regulation on providing the compensation can be adjusted regarding to the things such as : adjusting to the economic value reduction of the land and building that previously set at 15% (fifteen percent), accommodating the procedures that generally applied to the local community system in order to become the basis for PT PLN (Persero) in preparing facilities to provide the compensation, also clearly regulating the form of agreement between PT PLN (Persero) and the compensation recipients to avoid claims from new owners in the event of the transition of rights for the land, building and / or plants that have been previously given compensation.
