Abstract

The development and progress of the internet has driven progress in the field information Technology. The use of the internet is increasingly widespread in business activities, industry and households have changed the view of humans, in selling transactions buying any goods that were originally conventional gradually shifted become an electronic buying and selling transaction using the internet media known as E-commerce or electronic trading contracts. Then the problem which will be discussed are 1) What are the legal criteria that determine that letter electronics can serve as authentic evidence? 2) What are the criteria for a party authorized to issue electronic evidence? And 3) What is the concept of organizing electronic evidence in the future? Method the research used is normative legal research, which is used for produce arguments, theories, new concepts, interpretations as deep prescriptions solve problems using logic deductive thinking. From the results research that has been done it can be obtained is that there are aspects that are allowed laws based on the proof of reliability, neccesit. 2) the parties authorized to issue electronic evidence are notaries and electronic certificate operator. 3) the concept of regulation may include privacy rights, security, supervision and licensing for business actors. There are several suggestions from the result of this research is that there must be new regulations that regulate more clearly regarding proof of electronic transactions that are supported by supervision, legal protection, licensing for business actors, and security in transactions electronic.
