Abstract

Apryanda Kurniawan; Annalisa Y; Elmadiantini This research aims to find out and analyze how to transfer rights to registered brands through buy and sell agreements. In addition, this research aims to analyze the role of Notaries in the transfer of rights to registered brands through buy-to-sell agreements. This research is normative legal research. The approach taken in this study is a statutory approach as well as a comparative approach. The results of this study show that buy and sell agreements are the same as buy and sell agreements in general. It's just that, because the brand is as an intangible moving object so that in the sale – buy the brand delivery is done in a juridical way that the delivery of the brand occurs after the sale of the brand in accordance with the price agreed by the seller of the brand and the buyer of the brand. Furthermore, the role of Notaries in the transfer of brands in the form of selling – buying is in terms of providing legal counseling regarding the transfer of the brand using a sale agreement – the purchase of the brand is made with a Notarial deed which is an authentic deed that aims to obtain legal certainty and as a perfect proof tool.
