Abstract

Koperasi merupakan gerakan ekonomi rakyat yang berdasarkan atas asas kekeluargaan. Koperasi konvensional mengutamakan keuntungan untuk kesejahteraan anggota dengan membungakan uang. Dalam koperasi syariah, hal tersebut tidak dibenarkan karena bertentangan dengan prinsip syariah yang tidak mengenal bunga atau riba. Penelitian ini mengkaji mengenai peran notaris dalam pendirian koperasi syariah. Permasalahan penelitian ini mengenai perbedaan aspek prosedur dan substansi peranan notaris dalam pendirian koperasi konvensional dengan koperasi syariah, yang harus lebih diperhatikan oleh Notaris dalam pembuatan akta pendirian koperasi syariah, pertanggungjawaban seorang Notaris terhadap kebenaran data dari pendirian koperasi syariah yang dibuatnya. Jenis penelitian bersifat normatif berlandaskan pada teori kepastian hukum, teori kewenangan, teori tanggung jawab hukum, teori peran. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, sekunder, dan tersier. Penelitian hukum ini menggunakan pendekatan konseptual, pendekatan perundang-undangan, dan pendekatan sejarah hukum. Hasil penelitian bahwa pada dasarnya prosedur dan subtansi pendirian koperasi syariah memiliki kesamaan dengan koperasi konvensional karena tetap mengikuti peraturan pendirian pada koperasi konvensional. Notaris berwenang memberikan penyuluhan hukum secara aktif dalam pendirian koperasi syariah agar para pihak lebih memahami hukum yang berlaku. Notaris hanya mencatat apa yag disampaikan oleh para pihak untuk dituangkan ke dalam akta pendirian koperasi syariah. Kata Kunci: Koperasi Syariah, Koperasi, Notaris. ABSTRACT Cooperation is the people’s economic movement based on the principle of family values. Conventional cooperation takes interest from loan which is later used for its members’ welfare. In syariah cooperation, it is not allowed for its contradiction to syariah principle of not recognizing interst. This study aims at analysing the role of notary public in syariah cooperation establishment and it focuses on the distinction of conventional cooperation from syariah cooperation in relation to the roles of notary public in aspects of procedure and substance. It also tries to analyse the accountability of notary public toward the correctnes of data of syariah cooperation establishment he made. It is a normative study based on theories of legal certainty, authority, legal accountablility and roles. This study used primary, secondary and tertiary legal material and several approaches, i.e., conceptual, constitutional, history of law. The results show general similarity between both types of cooperation since they adhere to the same establishment regulation, i.e., conventional cooperation establishment regulation. Furthermore, the notary public has the authority to give explanation about the prevailing regulation on syariah cooperation establishment to the parties to better understand the regulation. The notary public take notes only what is conveyed by the parties to be written in the syariah cooperation establishment deed.
