Abstract

ABSTRACT This study aims to see the level of Indonesia's compliance in the AATHP International Regime. Forest fires are a phenomenon that has become history in Indonesia. Every year, forest fires still occur in areas that have large tropical forests such as Sumatra and Kalimantan. These forest fires cause smoke haze pollution which has an impact on countries around Indonesia, especially ASEAN member countries. This transboundary haze has paralyzed community activities and has a negative impact on health. ASEAN as an international organization formed an agreement that has the aim of dealing with the haze problem that occurs in the Southeast Asia region called the ASEAN Agreement on Transboundary Haze Pollution (AATHP). This agreement was signed on 10 June 2002 in Kuala Lumpur, Malaysia. Indonesia ratified this agreement in 2014 in the form of Law No.26 of 2014. After ratification, forest fires in Indonesia still occurred after the year of ratification. The purpose of this study aims to explain forest fires in Indonesia after AATHP ratification by using the International Regime Compliance approach. The International Regime Compliance Approach is used to analyze the extent of Indonesia's compliance with the AATHP agreement whether Indonesia is at the level of Active Compliance, Passive Compliance, Active-Non-Compliance or Passive-Non-Compliance. Forest fires that occurred in Indonesia after the ratification of the AATHP agreement were an element used to see the level of Indonesia's compliance with the AATHP agreement using qualitative descriptive research methods and research results showing that Indonesia's level of compliance with the AATHP agreement was at the Passive Compliance level. The Passive Compliance stage is a condition when a country has carried out the agreed commitment but there are circumstances that affect the state's process in carrying out the commitment. The level of compliance with Indonesia's Passive Compliance is determined by several factors, namely, the existence of ratification in the form of Law No.26 of 2014 is a form that Indonesia is carrying out the agreed commitments but there is still an increase in the number of hotspots and there are still post-forest fires. ratification in 2014 is an indicator of conditions that affect Indonesia in carrying out its commitments.
