Abstract
This study aims to analyze the basis for the application of the lex specialis derogat legi generali principle in the criminal justice system, the legal considerations of the public prosecutor (JPU) in prosecuting and judges who override the lex specialis derogat legi generali principle in the practice of convicting perpetrators of forest burning. and land, as well as criminal law policies against perpetrators of criminal acts of forest and land burning in the future. The results of this study indicate that, the basic legal basis for lex specialis derogat legi generali in the criminal justice system is the provisions of Article 63 paragraph (2) of the Criminal Code which states that if there is a criminal act that violates two or more provisions of the criminal law, one of which is the provision. general criminal law, and others are special criminal law provisions, then the special criminal law provisions are imposed on the perpetrators. The legal considerations of the prosecutors in prosecuting and judges in deciding that overriding the principle of lex specialis derogate legi generali in the practice of criminalizing perpetrators of forest and land burning crimes are the absence of criminal sanctions and subsidiary penalties in the Criminal Code and the conscience of prosecutors and judges with the freedom to determine demands and sanctions through light punishment because the crime has a special maximum limit. The criminal law policies against perpetrators of forest and land burning are: first, the application of criminal threats in prosecution and criminal sanctions in judges' decisions that are as heavy as possible and more precise, especially at legal subjects of non-individual business entities; second, the complete prohibition of forest burning without any reason, especially the prohibition of clearing land by burning forests completely, considering that no matter how small the burning is, it still has the potential to expand the results of the burning which causes extensive losses to public health, environmental sustainability and neighboring countries, Moreover, burning is carried out during the dry season and during times of low rainfall.
