Abstract

This study aims to determine and analyze the form and legal protection process, both preventive and legal protection Proportional repressive legal protection to insiders implementation of the car rental agreement. Writing in this thesis using empirical juridical methods. The type of data used is with field research and library research. While the data source was obtained through primary, secondary and tertiary data. Preventive legal protection in the case study Demang Rent Car Palembang uses written rental agreements, GPS installation in rental cars, insurance, and money deposit. Meanwhile, repressive protection is by solving problems through deliberation and kinship, imposition of fines, and settlement through the court. Proportional preventive legal protection The parties to this car rental agreement are important as the parties are having a risk of loss to the lease agreement is the business actor. So if it is not emphasized in prevention efforts, the biggest consequence is can lose the rental car due to unscrupulous persons in implementation lease agreement. And even though legal protection has been carried out which is repressive, but in practice, defaults often occur overmacht by individuals who are negligent in carrying out their obligations in implementation of the car rental agreement.
