Abstract

Skripsi ini berjudul Konflik Anarkisme Pada Pembentukan Norma Hukum Baru Dalam Peraturan Daerah Terhadap Negara Kesatuan Republik Indonesia (Dalam Perspektif Dahrendorf dan Bakunin), membahas Peraturan Daerah yang bertentangan dengan peraturan yang lebih tinggi. Dengan menggunakan perspektif dari Mikhail Bakunin dan Ralf Dahrendorf yaitu Anarkisme-Kolektivis dan Konflik sebagai bahan pendukung untuk melihat peraturan daerah yang diberikan kewenangan melalui Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintah Daerah, Undang-Undang Nomor 44 Tahun 1999 Tentang Keistimewaan Aceh. Adapun Peraturan Daerah yang menjadi fokus penulisan skripsi ini adalah Qanun Jinayat Nomor 6 Tahun 2014, adapun rumusan masalah ada dua yaitu Apakah Kewenangan Pemerintah Daerah Otonomi Khusus Dalam Membentuk Suatu Norma Hukum Baru Melalui Peraturan Daerah Bertentangan Dengan Konsep Negara Kesatuan, dan Bagaimanakah Perspektif Mikhail Bakunin dan Ralf Dahrendorf Terhadap Pembentukan Norma di Peraturan Daerah yang Tidak Sesuai Dengan Norma aturan yang ada di Atasnya. Adapun metode penelitian yang digunakan yaitu Yuridis Normatif, yaitu suatu prosedur penelitian ilmiah yang mengemukakan kebeneran berdasarkan logika keilmuan hukum dari sisi normatif. Bahwa dapat ditegaskan bahwa kewenangan suatu daerah diberikan otonomi khusus yaitu Aceh hanyalah sebatas mengatur daerahnya sendiri dengan kebijakan daerahnya sendiri, tapi ketika ingin mengatur mengenai pemidanaan kepada masyarakat Aceh harus melihat peraturan yang lebih tinggi. Juga mengenai pemikiran Bakunin dan Dahrendorf bahwa tidak salah dalam pembentukan norma hukum baru namun tetap harus menyesuaikan dengan peraturan yang lebih tinggi.
