Abstract

International Humanitarian Law was established to ensure that armed conflict can be conducted on humanitarian grounds. International Humanitarian Law has sought to protect the civilian population, which includes humanitarian volunteers. However, it is not an easy task whereas there are still many humanitarian volunteers who have died in carrying out their duties. Based on this background, this thesis raises issues such as what are the policies regarding the protection of the volunteers and what form of state responsibility conducted regarding the volunteers in armed conflict according to International Humanitarian Law. This thesis uses normative research methods in resulting that humanitarian law has provided protection aimed at the civilian population and humanitarian volunteers as non-combatants as outlined in the four 1949 Geneva Conventions and Additional Protocols I and II 1977 and in the event of a violation of the Convention and its Additional Protocols, the State Party is given the responsibility to establish regulations that contributes to the prohibition, prevention and prosecution of war crimes perpetrators in their national laws respectively.
