Abstract

ABSTRACT In land disputes, there is a prohibition on transfer of land rights in the process of civil disputes. This transfer happened in Manggul Village, Lahat Regency, in which the defendant’s act of secretly transferring the land rights during the trial process caused losses to the plaintiff so that it should be suspected that the defendant violated the principleof good faith, from which emerged a third party who claimed the land with proof of freehold land title. This study was normative law research with case approach anddeductive method to draw the conclusions. The results of the study showed that the judge decision in favour of the plaintiff after another party appeared to claim the land was still valid but it was not an executable decision because the object of the dispute was in the hands of simeone else; however, the plaintiff could file a suit for cancellation of land rights through the Administrative Court or write a letter to the Minister Of Agrarian Affairs. There were several factors causing the violation of the principle of good faith, namely honesty, unmonitored cases, inter-agensy coordination, verification, economy and legal factors. For the arrangement of transfer of land rights in the future, the panel of judges who tried the case ordered the parties to make an agreement on prohibition of transferring the object of dispute. There should be additional provisions in the civil procedural law which explicitly regulate the prohibition on transfer of land eights before any action taken by the goverment and requests for blocking and confiscation of guarantees from interested parties.
