Abstract

The coronavirus disease 19 (covid 19) global pandemic has a very significant impact not only on healt sector but also on all areas including economy. This study aims at discussing the following issues concerning the pandemic: (1) How is the impact of the covid 19 pandemic on business continuity? (2) Can the covid 19 pandemic be used as a rationale to apply for a debt payment postponement? (3) What are the obstacles in implementing the debt payment posponement during the pandemic? It is a normative legal study designed to generate new argument related to the legal issues discussing using the deductive method of drawing conclusions. The result of the analysis show that (1) The pandemic has a significant impact on the business world. It has reduced business activity in the tourism sector, import and exports, it also has caused banking, crises and reduced employment, and has started economic recession. (2) It is actually can be used as a case for debt posponement application since it is classified as force majeure in a relative sense. (3) Obstacles in debt postponement implementation during covid 19 pandemic are juridical and non- juridical causes. Juridical causes include hasty formation, rejection from the creditor, uncooperative creditors, inadequate assets, and actio pauliana, and non- juridical causes inlude legal structure, legal substance, and legal culture.
