Abstract

Adultery is a crime that is very disturbing morality in society. Adultery crime between positive Indonesian criminal law and criminal law of Islam has a different definition, the system of sanctions, and the proof For that purpose in writing this essay described the comparison between the draf t P e nal Code (P e nal C ode) and lslamic law on adultery evidence, using the method of normative legal research. Adultery in the Criminal Penal Code t o narrow the meaning of the definition of adultery under lslamic law, so that the application of sanctions and the burden of proof also experience the difference. in the draft Penal Code, adultery is a crime in pekawinan that involve only the people who do it themselves, whereas in lslamic law adultery is an act that is reprehensible and also have an impact on the surrounding community. For reasons that the existence of writing this essay, we can determine the ratio of adultery between the draft Penal Code (Penal Code) and lslamic law, and can provide suggestions for the development of theoretical aspects and practical improvements, to prevent and cope with adultery in society.
