Abstract

Skripsi ini berjudul “ANALISIS PERTIMBANGAN HAKIM DALAM MENJATUHKAN PIDANA TERHADAP PELAKU PENGANCAMAN DAN PEMERASAN VIDEO DAN FOTO PORNOGRAFI MELALUI MEDIA ELEKTRONIK (Studi Putusan No. 128/Pid.Sus/2020/PN Pwr dan 5/Pid.Sus/2021/PN Rtg ). Permasalahan dalam skripsi ini dituangkan dalam dua rumusan masalah, yang pada pokoknya mempertanyakan pertimbangan hakim dalam menjatuhkan pidana Dan Pertanggungjawaban Pidana Pelaku dalam kasus Pengancaman Dan Pemerasan Penyebaran Video Dan Foto Pornografi Melalui Media Elektronik. Untuk menjawab pertanyaan tersebut penulis menggunakan metode penelitian normatif dengan pendekatan kasus dan undang-undang. Dalam penelitian penulis menunjukan bahwa pertimbangan hakim dalam menjatuhkan pidana terdiri dari pertimbangan yuridis, sosiologis dan filosofis. Sementara hakim dalam Sistem hukum Indonesia, menentukan pertanggungjawaban pidana menggunakan teori monistis.
