Abstract

Notaries in the service sector are officials authorized by the state to serve the Notaries are public officials given the authority to make authentic deeds. In exercising the authority, notaries often gets problems in court or outside the court related to the deeds they made so notaries are required to be more careful in carrying out their duties and authorities. The problems of this study were formulated as follows: How was the implementation of the prudence principle in making deeds? What were the legal consequences for notaries who failed to apply the prudence principle in making deeds? This study used empirical research method, and the data were based on the situations experienced directly by notaries and resource persons. The results of the research show that notaries apply the prudence principle by checking the authenticity of the data and letters when the notary and clients meet. Placing fingerprints on the minutes is also one of the steps before the notary signs a deed, which is taking a careful action in making deeds. Besides, in carrying out their duties, notaries must always check the deeds made: the first inspection is carried out by the staff, then, the notary will correct the wording and content of the deed. The next step is that the notary reads the deed in front of the clients directly so that the clients understand the content of the deed and they are mu y op o the purpose of making the deed. In the digital era, some notaries have also added photos should e attachments s that there to is the supporting minutes evidence to indicateif that transactions have been carried out as it should be so that there is supporting evidence if problem apper in the future.
