Abstract

Tindak pidana korupsi merupakan salah satu tindak pidana yang khusus yang tergolong berat. Namun dalam beberapa putusan tindak pidana korupsi hakim justru menjatuhkan putusan bebas (vrijspraak) yang dimana putusan ini diresponi buruk oleh masyarakat dan menjatuhkan citra pengadilan di mata publik. Skripsi ini bertujuan untuk mengetahui dasar pertimbangan Hakim Pengadilan Negeri Palembang dalam menjatuhkan putusan bebas (vrijspraak) terhadap Terdakwa Muhammad Herison bin Komri Abas dalam tindak pidana korupsi yang tertuang di dalam Putusan Nomor 15/Pid.Sus-TPK/2016/PN. Penelitian ini merupakan penelitian normatif atau doktrinal yang bersifat deskriptif dengan menggunakan jenis data sekunder. Metode penelitian yang digunakan adalah studi kepustakaan, yaitu pengumpulan data sekunder yang ada hubungannya dengan masalah yang diteliti. Melalui hasil penelitian dapat disimpulkan bahwa hakim dalam menjatuhkan putusan bebas terhadap terdakwa Muhammad Herison dalam tindak pidana korupsi, Hakim Pengadilan Negeri Palembang memiliki dasar pertimbangan bahwa unsur-unsur perbuatan yang didakwakan oleh Jaksa Penuntut Umum baik dalam dakwaan primair maupun dakwaan subsidair tidak terbukti. Pertanggungjawaban pidana bagi para pelaku tindak pidana korupsi ialah dipidana penjara dengan penjara seumur hidup atau pidana penjara paling singkat 4 (empat) tahun dan paling lama 20 (dua puluh) tahun dan denda paling sedikit Rp. 200.000.000,00 (dua ratus juta rupiah) dan paling banyak Rp. 1.000.000.000,00 (satu milyar rupiah).
