Abstract

This study aims to examine the differences in fiduciary guarantee execution before and after the Chief of Police Regulation Number 8 of 2011 and the factors that become obstacles in securing the execution of Fiduciary Guarantees according to National Police Regulation Number 8 of 2011. This type of research in writing this thesis is normative legal research. Types and Sources of Legal Materials use pimer data and secondary data. Data collected was analyzed descriptively and qualitatively. The results of this study are that the implementation of fiduciary guarantee that distinguishes before and after the Chief of Police Regulation Number 8 of 2011 is before the establishment of the Chief of Police Regulation Number 8 of 2011, there are no regulations regarding Fiduciary Assistance which regulate further and more clearly who is authorized to ask for assistance in the execution of the Fiduciary Guarantee. However, after the establishment of the Chief of Police Regulation Number 8 of 2011, the police are the most authorized party in providing security assistance in the execution of Fiduciary Guarantees and Factors that become obstacles in Fiduciary Execution according to the National Police Regulation Number 8 of 2011 are objects of fiduciary collateral lost or moved; conditions in the field do not support; there is a commotion; the tempo of execution time is fast or not long; lack of police personnel; Police investigators at the time of security of execution are not equipped with a letter of assignment from the leadership.
