Abstract

Land certification aims to give a legal certainty to both the right owner and the enlistment object of land (area and boundary) which may prevent the unnecessary dispute. Since Indonesia is a law State, every single lawful action in Indonesia shall be based on law. The limited availability of land which is uneven with the need of land may inflict many problems –which therefore brings to the arising number of land problems caused by the titles of land. One of the main problems is regarding the unregistered lands, which may be caused due to the difficult process of land registration; such as the high cost or the bad performance of the government themselves which have not afford the citizens’ needs of a modest, safe, affordable, and transparent service. This is the background of why the Writer wishes to conduct a research on “The Certification of Land Owned by State which is Utilized by People into Freehold Title of Land in Lahat”. This research is conducted through normative legal method which aims tostudy the primary and secondary legal materials. This kind of method is also known as library research, due to its primary legal materials which consists of basic norms or principle, provisions and regulations which are related to this research. The inductive method is used to deduct the conclusion, aims to create a conclusion which is able to answer this thesis’ questions. Land certification especially in Lahat is not being operated well due to lots of problems on conducting the land certification such as the high cost, long-awaited process, the overlapping of land title, and the land boundaries themselves. The citizens should conduct the land certification themselves to avoid the unnecessary problems meanwhile the government shall be more active in socializing the effective land certification to its people.
