Abstract

Penelitian skripsi ini berjudul Pertanggungjawaban Pidana Pelaku Penerima Suap dalam Tindak Pidana Korupsi dalam kasus Terdakwa Pinangki Sirna Malasari, S.H., M.H. (Nomor 10/PID.TPK/2021/PT. DKI) dengan tujuan untuk menganalisa secara yuridis terhadap putusan nomor 10/PID.TPK/2021/PT. DKI dan putusan nomor 14/PID.TPK/2021/PT. DKI) telah sesuai dengan asas-asas keadilan dan prinsip yang berlaku didalam hukum pidana. Adapun rumusan masalah dalam skripsi ini yakni bagaimanakah pertanggungjawaban pidana pelaku penerima suap dalam tindak pidana korupsi dan bagaimana dasar pertimbangan Hakim dalam memutus perkara ini. Metode penelitian yang digunakan adalah pendekatan yuridis normatif, yang didukung pada data primer serta data kepustakaan sebagai sumber utama juga melihat dari hukum positif yang sedang berlaku. Hasil yang diperoleh dari penelitian ini tindak pidana suap menjadi yang tertinggi dalam perbuatan tindak pidana korupsi, pemberlakuan sanksinya masih belum efektif dalam memberantas tindak pidana korupsi di Indonesia. Adanya disparitas dalam putusan korupsi adalah karena tidak adanya pedoman pemidanaan dan Hakim memiliki kewenangan untuk menjatuhkan sanksi pidana.
