Abstract

Penelitian ini bertujuan Untuk mengetahui dan mengkaji Peran Majelis Kehormatan Notaris Terhadap Notaris yang dipanggil dalam proses peradilan perdata terkait akta yang dibuatnya, pertimbangan Majelis Kehormatan Notaris dalam memberikan Persetujuan atau Penolakan Terhadap Notaris Yang akan dipanggil dalam proses Peradilan perdata terkait akta yang dibuatnya, dan perlindungan hukum yang dilakukan Majelis Kehormatan Notaris Terhadap Notaris Yang akan dipanggil dalam proses Peradilan perdata terkait akta yang dibuatnya. Jenis penelitian tesis ini adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Bahan penelitian tesis ini terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Dari hasil penelitian bahwa Peran Majelis Kehormatan Notaris Terhadap Notaris Yang Di Panggil Dalam Proses Peradilan Perdata Terkait Dengan Akta Yang Dibuatnya hanya sebatas Pemberian Persetujuan atau Penolakan Permohonan Penegak Hukum, dan masih bersifat opsional yang mana sifat Opsional ini tergantung sikap Notaris (Hak Notaris) yang mana ditentukan Sendiri oleh Notaris yang bersangkutan yang menghadiri pemanggilan pengadilan tanpa izin Majelis Kehormatan Notaris. Pertimbangan-Pertimbangan Majelis Kehormatan Notaris dalam menentukan persetujuan atau penolakan Terhadap Notaris Yang akan dipanggil dalam proses Peradilan perdata terkait akta yang dibuatnya, aturan yang mengatur masih belum terperinci mengenai pertimbangan apa-apa saja yang menyebabkan permohonan pemanggilan tersebut disetujui atau ditolak, walaupun aturan mengenai pertimbangan ini masih belum terperinci para majelis kehormatan notaris tetap melakukan pertimbangan secara objektif berdasarkan keadaan yang sebenarnya tanpa dipengaruhi pendapat atau pandangan pribadi.. Perlindungan hukum terhadap Notaris oleh Majelis Kehormatan Notaris berupa kehadiran Majelis Kehormatan Notaris dalam melakukan Pemeriksaan seleksi (filter) mengenai urgensi kehadiran seorang Notaris dalam peradilan masih belum berjalan dengan baik karena masih bersifat opsional , Selain itu bentuk Perlindungan Notaris oleh Majelis Kehormatan Notaris adalah berupa Pembinaan kepada Notaris agar terhindar dari permasalahan yang dapat merugikan Notaris Bersangkutan.
