Abstract

Perang atau konflik bersenjata merupakan persoalan tragedi kemanusiaan. Saat terjadi konflik bersenjata, Organisasi Palang Merah Internasional memiliki peranan yang penting, dan dibentuk dengan tujuan memanusiawikan Perang. Penelitian ini bertujuan untuk mengetahui dan menjelaskan latar belakang timbulnya lambang Palang Merah dalam Hukum Humaniter Internasional serta untuk mengetahui dan menjelaskan mengenai pengaturan lambang Palang Merah dalam Hukum Nasional dan Hukum Internasional. Adapun metode penelitian yang digunakan adalah Penelitian Hukum Normatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa tujuan terbentuknya Palang Merah untuk mempermudah melakukan kegiatan kemanusiaan karena sering kali terjadi kesatuan medis yang menjadi sasaran dari para pihak yang terlibat konflik. Penggunaan lambang Palang Merah diatur secara khusus dalam Konvensi Jenewa 1949 dan peraturan Internasional lainnya yang telah diratifikasi di Indonesia seperti Undang-undang Nomor 1 Tahun 2018 mengenai Kepalangmerahan. Karena konflik bersenjata yang masih ada sampai dengan sekarang maka diharapkan setiap negara mampu menyebarkan pentingnya organisasi yang berjalan dalam bidang kemanusiaan ini guna untuk kepentingan bersama, serta melakukan sosialiasi terhadap masyarakat dalam lingkup Nasional maupun Internasional mengenai penggunaan dari lambang Palang Merah agar tidak terjadi penyalahgunaan pada nama Palang Merah. Kata Kunci: Hukum Humaniter Internasional, Lambang Palang Merah, Lambang Palang Merah Internasional. War or armed conflict is a matter of human tragedy. In the event of an armed conflict, the International Organization of the Red Cross had an important role, and was formed with the aim of humanizing the War. This study aims to find out and explain the background of the emergence of the Red Cross emblem in International Humanitarian Law and to know and explain the regulation of the Red Cross emblem in National Law and International Law. The research method used is Normative Legal Research. Based on the results of the study, it can be concluded that the purpose of the formation of the Red Cross is to facilitate humanitarian activities because there are often medical units that are targeted by parties to conflicts. The use of the Red Cross emblem is specifically regulated in the 1949 Geneva Convention and other International regulations that have been ratified in Indonesia such as Law Number 1 of 2018 concerning Headings. Because of the armed conflict that still exists today, it is hoped that every country will be able to spread the importance of organizations that run in this humanitarian field for the common good, as well as socialize the community in the National and International scope regarding the use of the Red Cross emblem so that there is no misuse of the Red Cross name.
