Abstract

Skripsi yang berjudul “Penerapan Kekebalan Personal Dikaitkan Dengan Prinsip Kekebalan dan Keistimewaan Diplomatik (Immunity and Inviolability) Menurut Hukum Internasional” ini di latar belakangi oleh banyak pendapat yang mengatakan bahwa Hukum Internasional tidak memiliki kekuatan hukum yang membuat penerapan Hukum Internasional tidak begitu baik bagi para agen diplomatik yang sedang ditugaskan di negara penerima. Banyak para agen diplomatik yang tetap mendapatkan penyerangan yang dimana sangat jelas diatur dalam Vienna Convention on Diplomatic Relation 1961 tentang konsep kekebalan personal dimana para agen diplomatik harus dilindungi keselamatan harkat dan martabatnya. Permasalahan yang dibahas dalam skripsi ini adalah: 1. Bagaimana pengaturan terhadap kekebalan personal dalam hukum internasional, 2. Bagaimana penerapan dari konsep kekebalan personal dikaitkan dengan kekebalan dan keistimewaan diplomatik menurut hukum internasional. Penelitian ini merupakan penelitian hukum normatif dimana menggunakan pendekatan peraturan perundang-undangan (Statue Approach) dan pendekatan konseptual (Conceptual Approach). Hasil penelitian ini mencerminkan bahwa konsep kekebalan personal telah diatur secara baik dalam hukum umum Hukum Internasional. Namun penerapan Vienna Convention on Diplomatic Relation 1961 yang mengatur tentang kekebalan pribadi seorang diplomat masih banyak menemui kekurangan yang menyebabkan masih banyaknya penyerangan kepada para agen diplomatik yang seharusnya dilindungi di bawah Hukum Internasional. This thesis entitled " The Implementation of Personal Immunity Associated with The Principal of Diplomatic Immunity and Inviolability According to International Law" This is motivated by many opinions that say that international law is a weak law in terms of its enforcement, which is because many countries have not ratified international law so that general law rules in international law cannot be binding. This makes the application of International Law not very good for diplomatic agents who are assigned to the receiving country. Many diplomatic agents continue to face attacks which are very clearly regulated in the 1961 Vienna Convention on Diplomatic Relations concerning the concept of personal immunity where diplomatic agents must be protected by the safety of their dignity. The issues discussed in this thesis are: 1. How are the rules about the immunity and inviolability according to International Law, 2. How is the implementation of the concept of personal immunity in applying the principle of diplomatic immunity and privileges according to international law. This research is a normative legal research which uses a statutory approach (Statue Approach) and a conceptual approach (Conceptual Approach). The results of this study reflect that the concept of personal immunity is compatible with general international law because diplomacy is a general rule of international law that regulates cross-border issues. However, the application of the 1961 Vienna Convention on Diplomatic Relations which regulates the personal immunity of a diplomat in its implementation still encounters many deficiencies which results in many attacks on diplomatic agents that should be protected under international law.
